Hate Crimes Bill....Clarification

The FBI was called in to investigate this 'hate crime'.....at Firehouse #1 on Jefferson Street in St. Louis, Missouri. Racism was alleged..So, the Mayor of the city called in the FBI to investigate. Here are the 'horrifying' results of their investigation.

Chris Molitor, head of the firefighters Local 73 union, said the stuffed animal had been found at a fire several weeks ago by personnel at the station, situated in the city's Hamilton Heights neighborhood.

"It was put on the coat rack because it was wet and it was drying," Molitor said.

As for the rope, he said, it "has been attached to that coat rack for several years."Public Safety Director Charles Bryson, who oversees the fire department, said the rope was used for training. "It is not a noose," Bryson said. "It's to practice tying knots."

GASP!! With H.R. 1913, this is an example of the complete ludicriousy we will have.

There was a comment to my last post on H.R. 1913 that implied the bill is simply to provide extra protection under the law for homosexuals/transgender, etc. etc. Wrong!

I will try to explain the bigger picture and problem with this bill...Let's say a pastor preaches against homosexuality....and some crazy guy listening to the sermon goes out and inflicts bodily harm upon a homosexual because his pastor says homosexuality is a sin.

That pastor could be prosecuted the same as the guy who actually comitted the crime because of Title 18, U.S. Criminal Code Sec. 2, which recites as follows:

Title 18 U.S.C. § 2. Principals. (a) Whoever commits an offense against the United States or aids, abets, counsels, commands, induces or procures its commission, is punishable as a principal. (b) Whoever willfully causes an act to be done which if directly performed by him or another would be an offense against the United States, is punishable as a principal.
Note: The legislative intent to punish as a principal not only one who directly commits an offense and one who "aids, abets, counsels, commands, induces or procures" another to commit an offense, but also anyone who causes the doing of an act which if done by him directly would render him guilty of an offense against the United States. Case law decisions: Rothenburg v. United States, 1918, 38 S.Ct. 18, 245 U.S. 480, 62 L.Ed. 414, and United States v. Giles, 1937, 57 S.Ct. 340, 300 U.S. 41, 81 L.Ed. 493.

It removes all doubt that one who puts in motion or assists in the illegal enterprise but causes the commission of an indispensable element of the offense by an innocent agent or instrumentality, is guilty as a principal even though he intentionally refrained from the direct act constituting the completed offense."

Sounds like the perfect loophole for any clever criminal defense lawyer...and the perfect loophole for a prosecuting attorney to file charges against the one who allegedly 'counseled.'

ALSO-Another problem with this bill is the broad language Congress uses: 'sexual orientation'. The American Psychiatric Assocation describes at least 30 sexual orientations.

The Hate Crime law, HR-1913, will make 30 sexual orientations federally-protected. The American Psychiatric Association (APA) has published 30 such sexual orientations that, because of Congress's failure to define "sexual orientation," will arguably be protected under this legislation. These 30 orientations are listed in the APA's Diagnostic and Statistical Manual of Mental Disorders (DSM-IV), which is used by physicians, psychologists, social workers, nurses, and psychiatrists throughout the U.S.

Among those sexual orientations are (Protecting 30 Bizarre "Sexual Orientations" And "Gender Identity" -- Ever-Expanding Definitions):
Fronteurism -- which involves a man approaching an unknown woman and rubbing up against her buttocks; this is already criminal behavior.
Incest -- which is a crime (sex with a daughter or son).
Necrophilia -- a crime (sex with a corpse).
Pedophilia -- a crime (sex with an underage child).
Prostitution -- a crime in most states.
Zoophilia -- (beastiality) which is a crime in numerous states.
Voyeurism -- which is a criminal offense in most states.

Non-criminal sexual orientations include such behaviors as:
Autogeynephilia -- the perception of a man as being a woman;
Apotemnophilia -- sexual arousal from the stumps of an amputee;
Coprophilia -- sexual arousal from feces;
Urophilia -- sexual arousal from urine
Transvestic Fetishism -- intense sexually-arousing fantasies, sexual urges, and behaviors involving cross-dressing.

To protect a "sexual orientation" under H.R. 1913 - while leaving that term undefined -- is to protect this whole range of bizarre sexual behaviors!

So, if your daughter is sexually molested, the perpetrator would be protected under Federal Law, H.R. 1913. Hey, facts are facts...and laws are laws.


But, what are the REAL statistics on crimes committed against homosexuals?
The latest FBI statistics from 2007 show that out of 1,521 victims of sexual orientation bias crimes, only 242 resulted in actual bodily harm. The rest were incidents of intimidation -- name-calling or shoving. This is hardly an epidemic of hate against homosexuals.
This is only 0.02827578411446785% of all aggravated assaults! Again, not exactly an epidemic of hate against LGBT individuals .

There are cases that we rarely hear about committed by....YES, even homosexuals. Here are a couple:

On November 21, William Smithson, 43, of Delaware County, Pennsylvania, was sentenced to life in prison for the September 2006 strangulation murder of 23-year-old Jason Shephard. Smithson, a homosexual, murdered Shephard after slipping him GHB, a date rape drug, then hid the body in the basement of his home. Luckily, Smithson is in prison today.

Two other murders committed by homosexual men that met with relative silence in the homosexual community -- the murder of 13-year-old Jesse Dirkhising in Arkansas in 1999, and the 2002 murder of Mary Stachowicz in Chicago.

As for 'extra protection' under the law....who's protecting the 42 million babies that are aborted every single year??!!! At the age of 17, girls can obtain the morning after pill without parental consent. Yet, at 17 yrs. old, they cannot buy cigarettes, liquor..they cannot vote..they cannot legally own a gun..they cannot join the military..they cannot sign a legal contract....but, murder? No problem!
